Terms of Service

Welcome to RENDERED. These Terms of Service (“Terms”) form a binding agreement between you and RENDERED (“we”, “us”, “our”) governing your access to and use of our website, services, and the digital goods sold through them (collectively, the “Service”). By using the Service you agree to these Terms. If you don’t agree, don’t use the Service.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service or make a purchase. If you’re using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Accounts

Some features require an account. You are responsible for keeping your login credentials secure and for everything that happens under your account. Notify us immediately at colby.ray@hyportdigital.com if you suspect unauthorized access.

3. The Service

RENDERED generates custom poster artwork from a place name and/or a photo you upload, using third-party generative AI models. After purchase, we render the final artwork at high resolution, package it into multiple standard print sizes (300 DPI), and deliver a downloadable zip archive via a signed link.

4. Your Content and Photo Rights

You retain ownership of any photos or text you submit (“User Content”). By submitting User Content, you represent and warrant that:

• You own it, or have all necessary rights, licenses, and permissions to use it for the purpose of generating a derivative poster.
• It does not depict any identifiable third party without their consent (especially minors), and does not infringe any copyright, trademark, publicity, privacy, or other right.
• It does not contain unlawful, harassing, defamatory, sexually explicit, or otherwise objectionable material.

You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, and transform your User Content solely to operate and deliver the Service to you. We do not use your photos to train AI models.

5. Generated Artwork

Subject to your full payment and your compliance with these Terms, we grant you a worldwide, perpetual, non-exclusive license to use the final generated poster files for personal and commercial purposes, including printing, displaying, and selling physical prints of the artwork. You may not resell or redistribute the digital files themselves, train machine-learning models on them, or claim authorship of the underlying generative process.

Because the artwork is produced by generative AI, copyright protection of AI-generated output is unsettled in many jurisdictions. We make no guarantee that the output is registrable for copyright protection in your name.

6. Prohibited Uses

You agree not to use the Service to:

• Generate posters depicting real, identifiable people without their consent; minors in any context; named celebrities, athletes, or fictional characters owned by third parties; or copyrighted brand/logo content.
• Generate sexually explicit, violent, hateful, harassing, or otherwise unlawful content.
• Reverse-engineer, scrape, or attempt to bypass our rate limits, bot protections, or content filters.
• Resell access to the Service or use it to power competing products without a separate written agreement.

We may suspend or terminate accounts that violate these rules, and we log content-filter blocks for fraud and abuse review.

7. Payment

Prices are listed on the site at the time of purchase and are in U.S. dollars. Payment is processed by Stripe; we don’t store your full card number on our servers. You authorize us to charge the payment method you provide for the total amount of your order including any applicable taxes.

8. Refunds

Because the Service delivers digital goods that are produced on demand, all sales are final. We will consider refunds case-by-case for verifiable technical failures (for example, your zip never being delivered, or being corrupted). See our Refund Policy for full details.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GENERATED OUTPUT WILL MATCH ANY SPECIFIC EXPECTATION, BE FREE OF ARTIFACTS, OR BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL POSTER SHOP OR ITS OPERATORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM AND (B) USD $50.

11. Indemnification

You agree to indemnify and hold harmless RENDERED and its operators from any third-party claim arising out of (a) your User Content, (b) your use of the generated output, or (c) your breach of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination (including Your Content licenses, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will survive.

13. Governing Law and Venue

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in New Hanover County, North Carolina, and you consent to the personal jurisdiction of those courts.

14. Changes

We may update these Terms from time to time. Material changes will be announced on the site or via email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
